Jessica Yaniv Simpson has finally replied to the Foreclosure, and it is gold. According to Jessica – the legal contract was too hard to legally understand and oh, being deaf meant he didn’t understand it. And we are meant to believe Jess is about to take the Bar test to be lawyer?
Let’s recap first before we wade through this big old pile of dung. Alta West Mortgage Capital own the mortgage on Yaniv’s apartment. In March 2025 they filed a request with the BC Courts to get payment of the $318,552.88 that was owed, plus accumulating interest and fees.
Instead of playing victim, Jonathan Yaniv aka Jessica Simpson evaded being served the legal documents, and hide in his 570 sq. ft. apartment. So In April 2025, Alta West asked the BC Court to agree that taping the files to the apartment building door and snail mailing a copy would be accepted as JYS being served. The court agreed and Jessica had 21 days to reply.
Well reply Jessica did, and it is spectacularly hilariously filled with excuses, contradictions and Jon saying he is too dumb to understand a legal agreement – and throws in the disability card for good measure.
Jon denies everything and is the victim.
Claims to have been conned into signing a fraudulent loan contract in 2022 and as such thinks he doesn’t have to pay his mortgage in November 2024.
Sorry Jonny Boy, that isn’t how financial legal contracts work my boy.
September 2017 – Jonny’s Momma Miriam Buys Him An Apartment
Let’s start at Jonathan agrees he purchased the apartment for $309,000 Canadian dollars in Sept 2017, or as we all know Miriam Yaniv bought it. From our Canadian realty expert – we are told that the cost would have had something called a Property Transfer Tax (PTT) that exists in BC Canada added on. According to the online calculator that would have added $4,180 to the cost, plus taxes and legal fees. But that real interesting note of (point 2) is in September 2017 when Jon set up the 5-year fixed term, 2.99% interest rate mortgage and a monthly payment obligation of $1,317.15 – but it was not with a regular bank.
Street Capital Bank was sold and is now owned by RFA Bank of Canada – the first lender in September 2017. So from the get go Jon was not using a standard bank, like his mother who appears to have her apartment mortgage with Scotiabank.
Fast forward to September 2022 – the 5 year term is up and it’s time for a mortgage renewal. RFA Bank of Canada REFUSED to renew with JYS. Jon says they are just big meanies that didn’t tell him why. But they most certainly would have, and most likely it was due to Jon no longer qualifying for the loan. Jon has no income, and the BC Government changed the threshold limits for loan qualification.
So Jonny started shopping around looking for an alternative lender that would give him a loan for his home.
He started talks with IMI Financial Group (Point 5) – while hassling RFA to pretty please reconsider (point 7) and RFA came back and said JYS had missed a few payments.

Jon is accusing RFA of lying, and says that he was never in arrears. Deferral payments mean you don’t pay at due date – but you still owe it, later. Maybe Legal Genius Yaniv doesn’t understand the word deferral?
Then Jessica Simpson self identified Legal Expert says a man named Ario Tootian swindled him. (Point 8)
Jon’s story, Mr. Tootian a mortgage broker for IMI Financial Group brokered a deal on a mortgage with a lender Pioneer West (Point 8) and JYS digitally signed an agreement – and later met at a notary office to finalize the deal.
While at the notary, Jessica says the deal had changed and it was now Alta West Capital (“Alta West”) holding the loan. At this point in the response, Jon claims he was FORCED to sign the mortgage document under duress, with Alta West in September 2022.
The Respondent who was already vulnerable due to her disabilities, including profound hearing impairment, was subjected to significant pressure and urgency at the notary’s office. The notary, arranged by Ario, rushed and pressured the Respondent to sign the documents immediately without affording her any meaningful opportunity to review, question, or understand the materially altered terms or the identity of the actual lender. The Respondent’s signature was obtained under conditions of duress, procedural unfairness, misrepresentation, and exploitation of her disabilities and vulnerabilities. The Respondent reasonably relied on the prior representations made by Ario and IMI Financial that she was contracting with PioneerWest and did not knowingly consent to entering into a mortgage agreement with Alta West.
But you know, the Legal Expert Jessica Yaniv did fuck all about this alleged scam, and paid her mortgage to Alta West up to September 2023. (Point 9) When Jessica the genius of all legal wizardry says big meanie Alta West just automatically renewed the mortgage for annual interest rate of 9.99%. And Jess the retarded disabled deaf woman didn’t sign that agreement either. But you know, just keep on paying it until 2024.
On or about October 16, 2024, the Respondent received an email communication from Alta West Capital (“Alta West”) advising that the Respondent’s mortgage had matured on October 1, 2024. The email further advised that, due to the Respondent’s purported failure to return a signed renewal offer, Alta West had unilaterally and without the Respondent’s consent renewed the mortgage into a six-month open term at an annual interest rate of 13.99%. (Point 10)
So does Jon just not check or open paper mail? There are legal arrangements in Canada that allow automatic renewal by Alta West. Some lenders will automatically renew your mortgage if you don’t respond to a renewal offer before the renewal.
I mean how utterly stupid do you have to be to not know the details of your mortgage for 2 years?
(Point 10) Alta West further advised that the Respondent’s new monthly payment under the imposed renewal terms would be $3,471.35, and that this amount would be automatically withdrawn from the Respondent’s designated account commencing on November 1, 2024. Alta West additionally advised that, if the Respondent agreed to new terms by October 25, 2024, it would offer a renewal at a revised interest rate of 10.99%.
If Jon was never given this info, and never given an option to negotiate a renewal, how does he have these details?
And NOT responding allows the bank to auto renew. If Jon had responded, they would have made a deal. It is all stinking of FAFO.
(Point 11) – Jon has a bank account with VanCity a Canadian bank. (Interestingly VanCity is not offering a Mortgage to Jon.) Alta West takes out money, from VanCity, for the new agreed amount and Jon pretends that he doesn’t know who “BC TRUST DEBT” is and reports it for fraud in November 2024 – stopping his mortgage payments. (In our opinion this was the start of the mortgage non-payment grift.)
After 2 years of paying Alta West, why would they change the name of who the payment was going to? Why would Jon not know the name of who was withdrawing the payment? None of that washes.
VanCity go on to determine that “BC TRUST DEBT” is Alta West in January 2025. (Point 12) Jon didn’t pay his mortgage in November, December, January and well we can assume hasn’t paid at all since. Here Jon reverts to claiming he thought the mortgage was with Pioneer West (Point 8) but by this point, he has admitted he knew it was Alta West way back in September 2022, when he signed the documents in September 2022.
So right there Jon’s lies conflict his story.
Plus by November 2024 he would have been well aware he had been paying Alta West for 2 years not Pioneer West. (Point 13)
The Grift Step 2
Then Jon claims in December 2024 (Point 14) he has filed a complaint with British Columbia Financial Services Authority (“BCFSA”) regarding the agreement he was “forced” to sign in September 2022.
They ask for correspondence for a few weeks of December 2024?
However the original deal was done in September 2022. Jon is claiming that (Point 8) Ario Tootian and IMI Financial swindled him because Ario Tootian was never a mortgage broker.
But then the very next Point 15 contradicts himself again, and remember the original deal was signed in September 2022…
Ario Tootian (“Ario”) had been registered as a licensed mortgage broker in British Columbia only until December 7, 2024.
At this junction the entire reply falls apart into accusations that Ario Tootian and IMI, and Alta West are to blame for Jon not paying. It is pitiful, and frankly we can not wait for Alta West Mortgage to respond.
Then Jon goes on to complain about having an Interest Only loan. (A loan where you only pay interest, and nothing toward the principal is usually lower costs.)
Then the reply becomes even weirder and wilder.
Point 19 – Jon claims a new mortgage was offered to him, but by some other lender Capital Direct Lending Corp. (“CapitalDirect”). Jon says he got a letter dated November 8th, 2024 but not until it had expired on December 13th. (Edit to include a note: Apparently there was a Canada Post strike in Canada between November 15 and December 17 and no one was receiving snail mail.)
He includes all the details and complains about the fees. And poor disabled Jon couldn’t understand the offer, so he used an online legal website Access Pro Bono for legal help. Yah, Legal Expert needs Legal help Pro Bono (for free) lol!
Then Jon goes on to say Harman Sidhu (President of IMI)* was sending him fraudulent agreements to sign a new SECOND mortgage deal in December 2024. DUH. Jon you defaulted your Mortgage and didn’t pay November 2024. So they are (quite frankly kindly) offering you a new deal.
MM fully expect some more LOLsuits to follow against the named individuals.
Thankfully though, not once did Jessica mention being indigenous or Métis. Jess is just disabled, deaf and dumb. According to Jess.
